Terms and Conditions for Rising Careers

Welcome to Rising Careers. These Terms and Conditions (“Terms”) govern your access to and use of the Rising Careers website (the “Site”) and the services we provide, including subscription-based access to career resources such as resume templates, interview preparation materials, job search strategies, and related tools (collectively, the “Services”).

By accessing or using our Site and Services, or by creating an account or clicking “I agree” during sign-up, you confirm that you have read, understood, and agreed to be bound by these Terms and our Privacy Policy. If you do not agree, you must not access or use the Site or Services.


1. Eligibility and Scope

These Terms apply to:

  • Members (Job Seekers): Individuals who subscribe to or access Rising Careers’ career development tools and resources.

  • Employers (Business Clients): Organizations purchasing access to Rising Careers’ Services on behalf of their displaced employees as part of a severance or outplacement support package.

To use our Services, you must:

  • Be at least 18 years old or have reached the age of majority in your jurisdiction;

  • Have the legal capacity to enter into a binding contract; and

  • Comply with these Terms and all applicable laws.


2. Employer-Funded Access

Eligible Members may receive free access to our Services through their employer.

  • Access is time-limited and will terminate automatically at the end of the employer-funded term.

  • Members will be notified in advance of the expiration.

  • Members are not required to pay for this access.


3. Employer Subscriptions and Payment Terms

a. Subscription Plans
Employers may purchase Services on a per-employee, per-month basis. Full pricing and service details are provided prior to contract execution and incorporated into the agreement.

b. Payment Terms
Employers agree to pay upfront for the contracted term, subject to net 30 payment terms unless otherwise agreed. No refunds are issued. If fewer employees are laid off than anticipated, the agreement may be amended accordingly.

c. Employee Data
Employers are not required to submit personal data. Instead, Rising Careers will issue a unique sign-up link for employees to register voluntarily.


4. Member Responsibilities and Acceptable Use

a. Account Security
Members are responsible for maintaining the confidentiality of their login credentials and ensuring that all account information is accurate and up to date. You are responsible for all activity conducted through your account.

b. Prohibited Activities
You agree not to:

  • Use the Services for any unlawful or unauthorized purpose;

  • Share your credentials or allow others to access your account;

  • Reproduce, distribute, sell, or modify any Service content without written consent;

  • Attempt to interfere with or harm the functionality or security of the Site.


5. Intellectual Property

All content, designs, text, graphics, software, templates, and other materials provided through the Services are the intellectual property of Rising Careers or its licensors and are protected by copyright, trademark, and other laws.

You are granted a limited, non-transferable, non-sublicensable, non-exclusive license to use the materials solely for your personal, non-commercial use. Any unauthorized use is strictly prohibited.


6. No Guarantees of Employment or Interviews

Rising Careers provides career tools and educational content. We do not guarantee employment, interviews, or any particular career outcomes. Success depends on individual effort and external factors beyond our control.


7. Limitation of Liability

To the maximum extent permitted by law, Rising Careers shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including loss of employment opportunities, income, data, or goodwill, arising from your use of the Site or Services.


8. Indemnification

You agree to indemnify, defend, and hold harmless Rising Careers, its affiliates, officers, directors, employees, contractors, and licensors from any claims, losses, damages, liabilities, costs, and expenses (including legal fees) arising out of:

  • Your use of the Site or Services;

  • Your breach of these Terms;

  • Any violation of applicable law or third-party rights.


9. Termination of Access

Access to Services will automatically terminate at the end of the employer-funded term. Rising Careers may suspend or terminate access at any time for violations of these Terms. Upon termination, all rights granted to you will immediately cease.


10. Modifications to Terms and Services

We may modify these Terms or the Services at any time. Updated Terms will be posted on this page and are effective upon posting. Continued use of the Site after updates constitutes your acceptance of the revised Terms. Please check this page periodically.


11. Dispute Resolution and Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Province of British Columbia, Canada, without regard to conflict of law rules.

You agree that any disputes or claims shall be submitted to the exclusive jurisdiction of the courts of British Columbia. We may also agree to resolve disputes through mediation or arbitration at our discretion.


12. Force Majeure

Rising Careers shall not be liable for any failure or delay in performance resulting from causes beyond our reasonable control, including but not limited to natural disasters, acts of war, internet outages, labor strikes, or governmental actions.


13. Feedback

Any feedback, suggestions, or ideas you submit may be used by Rising Careers without obligation, compensation, or restriction, and you hereby grant us a non-exclusive, perpetual, irrevocable license to use such submissions.


14. Severability and Entire Agreement

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. These Terms, along with our Privacy Policy and any additional agreements, constitute the entire agreement between you and Rising Careers.
